Your use of the website at DavidEKAbramson.com and its contents (the Site) is governed by these Terms of Use (TOU), as well as Site’s Privacy Policy and Cookie Policy (collectively: Terms).  By accessing or otherwise viewing or making use of the Site, you agree to be bound by these Terms.  If you do not wish to be bound by the Terms, simply do not view, access, or make use of the Site.

General Terms:

The information, software, and any other content provided on the Site (Content) are provided on an as-is basis without any warranty as to accuracy, timeliness, and fitness for any particular purpose.  In particular, any software, applications, or “apps” hosted or downloadable via the Site (Software) are provided to you on an as-is basis and likely contain bugs, mistakes in coding, or other defects that may make them unsuitable for use in a production environment.  Use of any Software is at your sole risk, and you bear full responsibility for any damages caused by your election to use the Software.  You agree to indemnify, defend, and hold harmless the creators of the Software and any related parties, including owners, officers, directors, employees, agents, successors and assigns, from any expense, liability, or damage that may result from your use of the Software.

Beyond any instructions or advice already found on the Site itself, no support is provided for use of the Software.

The Site is not warranted to be "hardened" or otherwise secured against attack from third parties and does not currently employ encryption in all its data storage mechanisms.  By your use of the Site you acknowledge that the security of the Site and of your information stored on the Site cannot be guaranteed and agree to indemnify, defend, and hold harmless the creator of the Site and any related parties, including owners, officers, directors, employees, agents, successors and assigns, from any expense, liability, or damage that may result from release of your Personal Information.

Access to video clips:

Access to video clips of third-party content is solely offered as a means to determine the skills and prior work experience of David E.K. Abramson. No entertainment or commercial purpose is intended, and your viewing of such clips constitutes and agreement to abide by that intention. Any form of capture of the content is strictly forbidden, and viewing of the clips presented must solely occur while on this website.

For Access to Restricted Content (e.g.: hidden video clips, or resources relating to The Well software):

When (optionally) registering a new user account, the Site makes use of Google’s Recaptcha service, which would subject you to Google’s Terms of Use and Privacy Policies, links to which are included on this site's new-user registration page.  If you do not agree to Google’s Terms of Use and Privacy Policies, do not register an account on the Site.

You assert and affirm that you are of legal age and can be bound by this agreement.

To view most content on DavidEKAbramson.com (the Site), you are not required to submit any personal information.  However, access to certain content – including, for example, certain video clips, or files relating to the sound effects database application The Well (Restricted Content), or mailing list emails (Subscribed Content) – may at times or in certain contexts be restricted to registered users only.

If you choose to register for access to Restricted Content and/or Subscribed Content, you will in each case be asked to provide your name and a valid email address, and in the case of Restricted Content you will be asked to provide a password (ideally a password uniquely created for the Site and not shared with any other sites or services).  Together, these items constitute your Personal Information relating to the Site.

While registering, your identity as a human (as opposed to a "bot") may be automatically checked via Google’s Recaptcha service, which will subject you to Google’s Terms of Use and Privacy Policies, links to which are included on this site's new-user registration page.

Your Personal Information is collected solely for the purpose of allowing you to access the Content and to communicate with you about that access (for example: mailing list emails, password reset emails, or emails concerning new versions of The Well).

Third-party software services:

Third-party software services (Services) may be used to administer subscriptions and control availability of Content. By using this site, you agree to the use of these Services, which may change from time to time. Aside from transmitting your Personal Information to any such Services for the purposes indicated above, your Personal Information will not knowingly be transmitted to any third parties.

IMPORTANT NOTICE CONCERNING SECURITY AND PRIVACY:

As of the latest revision of this Policy, the Site is not hosted on a server that employs encryption or other security measures in all its mechanisms.  You should assume that your Personal Information, including your password for the Site, is being stored and/or transmitted in plain-text and could be intercepted and read by a third party.  Also, the Site is hosted on a shared server along with other websites and therefore, although measures have been taken to harden the Site itself from intrusion, a third party may be able to gain access to the Site or the entire shared server and potentially read your Personal Information. Similar risks may arise from the use of third-party Services as mentioned above.

The Site’s Terms of Use limit your rights in case of a breach of your Personal Information, so please make yourself familiar with them.
